Dubai Real Estate Trustee Offices: Off-Plan Buyer's Guide

Dubai Real Estate Trustee Offices: Off-Plan Buyer's Guide

Written by the Bramwell & Partners advisory team, Abu Dhabi real estate advisors. Last reviewed: October 2026.

Real estate trustee offices are Dubai Land Department-authorised service centres that process property registration transactions through DLD's own systems. If you buy off-plan directly from a developer, you may never visit one, the developer registers the initial sale and your Oqood arrives without a trustee appointment. But the moment you sell your contract before handover, buy an off-plan resale, or register a mortgage or title at completion, the trustee office becomes the room where your transaction is legally executed. This guide explains what they do, what they charge, and when you actually need one.

Key takeaways

  • Trustee offices are DLD-licensed registration channels, not brokers, lawyers or banks, they process transactions; they do not advise on them.
  • A direct developer purchase usually never touches a trustee office; assignments, resales, mortgages and title issuance do.
  • Fees are fixed by DLD: AED 4,000 + VAT for property sales of AED 500,000 or more (AED 2,000 + VAT below), plus the 4% DLD transfer fee, AED 250 title deed fee and small map/knowledge charges.
  • Trustee offices and escrow accounts are unrelated: one registers ownership events, the other holds construction money.
  • Always verify the office appears on DLD's published list of approved registration trustees before attending or paying.

What a trustee office actually is

Dubai Land Department does not process every transaction from its own counters. It licenses a network of Real Estate Registration Trustee centres, private offices connected directly to DLD's registration system, to receive documents, verify identities, collect fees and submit authorised transactions on the department's behalf. The title deed, Oqood record or registration certificate that results is issued by DLD itself; the trustee office is the front counter.

That division of labour matters. A trustee office can confirm whether your paperwork is complete and process an authorised transaction. It cannot negotiate your SPA, resolve a dispute with your developer, or validate a side agreement. Its authority begins and ends with registration. In our transaction work, the appointments that fail are rarely about missing documents, they are about parties expecting the office to fix a contract problem it has no mandate to touch.

When off-plan buyers do, and don't, use one

Transaction Trustee office involved? Who drives the process
Buying off-plan directly from a developer Usually no, developer registers the initial sale with DLD; Oqood is issued Developer's registration team
Buying an off-plan resale / assignment Yes, the change of buyer is registered through an authorised channel Seller, buyer, developer (NOC) + trustee office
Registering a mortgage on a completed or Oqood-registered unit Yes, often arranged by the bank Bank + trustee office
Title deed issuance at handover Developer coordinates; trustee channel may process Developer + DLD/trustee channel
Completed (secondary) property sale Yes, the classic trustee transaction Buyer, seller, brokers + trustee office

The standard developer purchase

Your part is simple: complete the buyer forms, pay through the approved channels and sign the SPA. The developer then submits the Request to Register the Initial Sale to DLD, paying the 4% registration fee on your behalf (collected from you), and DLD records the interim registration known as Oqood. Keep that Oqood certificate permanently, it is the evidence of your off-plan interest until the title deed is issued at completion.

The assignment sale: where trustee offices matter most

An assignment, selling your off-plan contract before handover, replaces you as the registered buyer, so it must pass through both the developer and the DLD system:

  1. Meet the developer's conditions. Most SPAs require a minimum percentage paid (30–40% is common, but your SPA governs), all instalments current, and an administration/NOC fee, typically AED 500–5,000 depending on the developer.
  2. Obtain the developer's eNOC, usually issued through Dubai REST.
  3. Attend the trustee office (buyer, seller or properly empowered representatives) with the SPA, Oqood record, NOC, IDs and transaction forms.
  4. Pay the registration charges: 4% of the sale value to DLD (customarily borne per the parties' agreement), trustee service fee of AED 4,000 + VAT (or AED 2,000 + VAT under AED 500,000), title/registration issuance fees and minor map/knowledge charges.
  5. Leave with the official record naming the new buyer, plus receipts for every dirham paid. When we run assignment files, the eNOC timing sets the whole calendar, developers quote anything from three working days to three weeks, so we book the trustee appointment only after the NOC is in hand.

The developer decides whether its contractual conditions are met; the trustee office registers the approved change. Neither can substitute for the other.

The full fee picture (DLD-published)

Trustee fees are fixed by DLD and identical at every licensed office, anyone quoting a different "trustee fee" is quoting something else.

Trustee office vs escrow account: kill the confusion

The word "trustee" causes real harm here, because buyers sometimes send construction instalments to the wrong place. The two concepts are entirely separate:

Trustee office Project escrow account
What it is DLD-authorised registration service centre Ring-fenced project bank account under Law No. 8 of 2007
What it handles Ownership events: sales, assignments, mortgages, titles Your construction-linked instalments
Who sets the rules DLD RERA/DLD escrow framework via the project's escrow agent bank
How you pay it Service fees at the appointment Only to the account named in the developer's official payment instruction

If anyone directs a property instalment to a trustee office, a personal account, or any account that does not match the project's official escrow instruction, stop and verify with DLD before paying.

How to prepare for a trustee appointment

Ask for the written checklist in advance and arrive with one complete file:

  • The named DLD service being processed, in writing, with the expected output document.
  • Attendees: whether buyer, seller or both must attend, and the acceptance criteria for a power of attorney (POA wording, notarisation, attestation, and translation if executed abroad).
  • Property file: SPA, Oqood or title record, developer eNOC, and evidence that all developer dues are cleared.
  • Identity and finance: passports/Emirates IDs, contact details, and bank papers (liability letters, manager's cheques) where a mortgage is being registered or released.
  • Money map: every amount, payee and payment method written down before you arrive, manager's cheques are still the norm for large DLD payments.

With a complete file, a straightforward registration can finish in under an hour. Incomplete POAs, unpaid service charges and late NOCs cause nearly all the delays.

A generalised example from our files: an overseas seller's power of attorney was rejected at the counter because the attestation chain omitted one step required for the country of execution, a detail invisible until the appointment. The transaction completed four weeks later after re-notarisation. We now insist on the trustee office confirming POA wording and attestation requirements in writing before any client books travel.

A typical appointment, step by step

With a complete file, a standard registration runs to a predictable rhythm:

  1. Check-in and document verification. The trustee officer verifies IDs, the SPA or title record, the NOC and the transaction forms. Anything missing stops the process here.
  2. Fee confirmation. You receive the itemised breakdown, DLD fee, trustee service fee, title issuance, map and knowledge charges, before any payment moves.
  3. Payment. Large amounts move by manager's cheque or approved electronic channels; receipts are issued per payment.
  4. Submission to DLD. The transaction is entered into DLD's system live; approval for a clean file typically comes back the same visit.
  5. Issuance. You receive the electronic title deed or registration certificate, the updated map and your full receipt set.

DLD's published service time for a standard sale registration is around 25 minutes of actual processing; the queue and document checks take the rest. Book ahead where the office allows it.

Three red flags that should stop any transaction

  1. The service is unnamed. A legitimate instruction identifies the exact DLD service and the document it produces. "Registration fee" without a service name is not good enough.
  2. Payment details conflict with the paperwork. A changed payee without a revised written instruction, an instalment routed to a personal account, or fees bundled into an unexplained total, all mean stop.
  3. The promise exceeds the office's role. A trustee office processes registrations. It cannot amend your SPA, waive developer conditions or settle disputes. Anyone suggesting otherwise is selling something.

The Abu Dhabi comparison

Abu Dhabi runs the equivalent functions through the Abu Dhabi Real Estate Centre (ADREC) and the emirate's digital registration channels rather than a trustee-office network. Registration friction is lower: mortgage registration is around 0.1% of the loan versus Dubai's 0.25%, and the emirate's sale registration charges differ from DLD's 4%. The buyer-side discipline, verify the authorised channel, match payees to instructions, keep every receipt, is identical.

"Trustee offices are efficient precisely because their role is narrow, but that narrowness is where buyers get hurt. The office will not tell you the SPA you are signing away your rights under, or that the 'fee breakdown' includes a charge nobody authorised. Do your due diligence before the appointment, and treat the trustee visit as execution only: complete file, verified payees, named service, written receipt."

Frequently asked questions

Does every Dubai off-plan buyer visit a trustee office?

No. A direct developer purchase is registered by the developer with DLD, and your Oqood arrives without any trustee appointment. You encounter trustee offices for assignments, resales, mortgage registrations and some title-issuance routes.

Is a trustee office part of Dubai Land Department?

It is a private service centre licensed and audited by DLD with direct access to the department's registration system. DLD remains the government authority; the trustee office is an authorised channel.

How much are trustee office fees in Dubai?

DLD fixes them: AED 4,000 + VAT for sales of AED 500,000 or more, AED 2,000 + VAT below that, plus the 4% DLD transfer fee, AED 250 title/registration issuance, map fees and small knowledge/innovation charges.

Who registers an off-plan assignment, the developer or the trustee office?

Both, in sequence. The developer confirms its contractual conditions are met and issues the NOC; the trustee office verifies the file and registers the change of buyer in DLD's system. Neither step works without the other.

Can someone attend on my behalf under a power of attorney?

Yes, provided the POA meets the transaction's requirements, correct wording, notarisation, attestation if executed abroad, and Arabic translation where applicable. Confirm acceptance criteria with the trustee office before the appointment.

How do I verify a trustee office is legitimate?

Check it against the approved list published by Dubai Land Department, and remember that trustee fees are fixed by DLD, identical at every licensed office.

How we verify this guide. Fees and procedures were checked against Dubai Land Department's published service pages (Property Sale Registration; Registering the Sale of a Mortgaged Property) and DLD's approved-trustee framework in October 2026, alongside our own transaction files. Fees and document lists change, confirm current figures on dubailand.gov.ae before any appointment.
